Atty. Ramil Joselito Tamayo, whose appointment by Gov. Patrick Alain Azanza as Attorney IV was rejected by the Sangguniang Panlalawigan and recently rehired as job-order Community Affairs Officer, has filed an administrative complaint against his former allies-turned-tormentors, PBM Giovannio Balmadrid and PBM Arnel Turado, before the Office of the President.
The suit asks Malacañang to remove the two respondents from office as members of the provincial board for violating Section 60(c) and (e) of the Local Government Code.
It also sought the imposition of accessory penalties of forfeiture of retirement benefits and their perpetual disqualification from holding public office.
Tamayo alleges that by wrongly interpreting the position of the COMELEC regional director that he (Tamayo) as to his qualification for appointment to the post, the PBMs used their position to discredit and ruin Tamayo’s reputation.
Likewise, he accused the two veteran legislators of dishonesty, oppression and misconduct in unlawfully making it appear through their respective privilege speeches that Tamayo is corrupt and is using government resources for his own benefit.
The respondents allegedly used PEO employees as accomplices to implicate Tamayo and illegally secured their Daily Time Records from the concerned offices as evidence.
The lawyer and former Ako Tanod third nominee submitted as documentary evidence the letter of the COMELEC official to prove that he is not disqualified to be appointed to any position in the provincial government; a letter from Gov. Azanza proving that Tamayo’s duties as Attorney IV will not be the same as that of the Provincial Legal Officer; a sworn affidavit of PEO employee Roberto Tarroza that he was instructed to take pictures of their work at Moonwalk, San Isidro Village; screenshots of the conversation between Tarroza, another PEO employee and PBM Balmadrid; and a copy of the video of the two PBMs’ privilege speech circulating on social media.
Tarroza will also be presented as witness to prove that all allegations in Balmadrid’s privilege speech are false and that the photos he sent to the PBM were used in the privilege speech without his consent.
As an immediate consequence of the filing of the complaint, Gov. Azanza has already communicated to the SP that it cannot accommodate the latter’s request that Atty. Tamayo, two PEO engineers and seven other employees from attending last Monday’s regular session.
“Any further clarification or discussing relative to the statements or issues raised during the session where PBM Balmadrid and PBM Turado made their speeches has become moot and academic and subjudice,” Azanza stated. “It is already under the jurisdiction of the Office of the President and therefore should not be the subject of further discussion, debate, or investigation by another body such as the Sangguniang Panlalawigan.”

With a majority of SP members in the opposition and 80 percent of the Capitol officials and employees believed to be Cua supporters, Gov. Azanza has started bringing in trusted staff from CatSU.
Soon, vacant positions at the provincial government will be filled up with qualified loyalists and supporters.
In the same situation as the governor is San Miguel Mayor Tony Teves, who is literally surrounded by Camano appointees as well as the Camano allies at the Sangguniang Bayan.
Four councilors who won as independents cannot be counted on for support as they usually side with the majority.
